The COVID-19 pandemic that has gripped the world since early 2020 underscored need for an effective right to repair medical equipment. As healthcare systems have been pushed limit, keeping critical equipment (such as ventilators) in working order become a matter of life and death. Unfortunately, ability hospitals other health care providers service fix their is often hindered by tight control original manufacturers keep over products. On top direct contractual restrictions on repair, one major difficulties encountered hospital-based third-party lack access manuals, keys, schematics, replacement parts, tools. block these items abetted, large part, intellectual property laws. In August 2020, new federal legislation was introduced address this problem—the Critical Medical Infrastructure Right-to-Repair Act (the “Act”). designed facilitate infrastructure during current pandemic, do so, it addresses various relevant issues. This Article provides analysis examines extent which could serve its prescribed goal. We also investigate role courts play, alongside such legislation, using policy levers already exist law provide relief independent technicians mandate cooperate with them certain circumstances.
